Terms of Service

1. Agreement to Terms

By accessing or using Qrafted ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. We reserve the right to update and change these Terms at any time. Continued use of the Service after any such changes constitutes your acceptance of the new Terms.

2. Description of Service

Qrafted provides a QR code generation and management platform that allows users to:

• Create static and dynamic QR codes
• Customize QR code appearance
• Track QR code scans and analytics
• Manage QR codes through a dashboard
• Access QR code generation via API (Business plan)

3. Account Registration

To access certain features of the Service, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to use this Service. By using this Service, you represent and warrant that you meet this requirement.

4. Subscription Plans and Billing

4.1 Free Plan

The free plan includes limited features and QR code creation limits as described on our pricing page. Free accounts may display a Qrafted watermark on QR codes.

4.2 Paid Plans

Paid subscriptions (Pro and Business plans) are billed in advance on a monthly or annual basis. You agree to pay all fees associated with your selected plan.

4.3 Automatic Renewal

Subscriptions automatically renew unless cancelled before the end of the current billing period. You can cancel your subscription at any time through your account settings.

4.4 Refunds

We offer a 14-day money-back guarantee for new subscriptions. After this period, payments are non-refundable. Refunds are not available for partial months of service or for unused features.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Distribute malware, viruses, or harmful code
• Send spam or unsolicited messages
• Create QR codes linking to illegal, harmful, or fraudulent content
• Impersonate any person or entity
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to the Service
• Collect or harvest user information without consent
• Use the Service for any illegal or unauthorized purpose

6. Intellectual Property

6.1 Our Content

The Service and its original content, features, and functionality are owned by Qrafted and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Your Content

You retain ownership of any content you create using the Service (QR codes, uploaded logos, etc.). By using the Service, you grant us a license to host, store, and display your content as necessary to provide the Service.

6.3 QR Codes

QR codes created using our Service may be used for any lawful purpose. You are responsible for ensuring that the content linked to your QR codes complies with these Terms and applicable laws.

7. Service Availability

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance
• Emergency repairs
• Force majeure events
• Third-party service outages

We will make reasonable efforts to notify users of scheduled maintenance in advance.

8. API Usage

For Business plan users with API access:

• API keys must be kept confidential
• You are responsible for all activity under your API key
• Rate limits apply and may be adjusted
• API access may be revoked for abuse or violation of these Terms
• You may not resell or redistribute API access without permission

9. Termination

We may terminate or suspend your account immediately, without prior notice, for:

• Breach of these Terms
• Non-payment of fees
• Fraudulent or illegal activity
• At our sole discretion for any reason

Upon termination, your right to use the Service will immediately cease. Dynamic QR codes will stop redirecting and analytics data may be deleted.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QRAFTED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or business opportunities
• Service interruptions or data breaches
• Errors or omissions in the Service
• Any unauthorized access to your data

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Indemnification

You agree to indemnify, defend, and hold harmless Qrafted and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including attorney's fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of San Francisco County, California.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by email or by posting a notice on our website. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
